FAMILY
EDUCATIONAL RIGHTS AND PRIVACY ACT OF 1974
Pursuant to the provisions of the Family Educational Rights and
Privacy Act of 1974, the Board of Education of the Monticello
Central School District has adopted the following regulations to
implement the law:
Student records described in the Family Educational Rights and
Privacy Act of 1974 are available during regular school hours within
forty-five days of the request by qualified persons to the
appropriate school personnel stated below.
1. Elementary - Those qualified
to inspect record data to make an appointment with building
principals of the following schools to see records between the hours
of 9:00 a.m. and 3:00 p.m.
Emma C. Chase School - Wurtsboro, NY 12790
George L. Cooke School - Monticello, NY 12701
Cornelius Duggan School - White Lake, NY 12786
Kenneth L. Rutherford School- Monticello, NY 12701
2. Secondary - Those qualified
to inspect record data to make an appointment with guidance
counselors in the following buildings to see records or assistant
principals of said buildings for records concerning student
behavior, between the hours of 8:00 a.m. and 2:00 p.m.
R.J.K. Middle School – 45 Breakey Avenue, Monticello, NY
Monticello High School – 39 Breakey Avenue, Monticello, NY
3. All requests for psychiatric or
psychological record inspection to be made with school
psychologists at Pupil Personnel Services Building located at
Monticello High School, between the hours of 8:30 a.m. and 3:00 p.m.
4. All requests for health records
to be made with school nurse serving that building, between the
hours stated above.
5. All requests to inspect materials being
used in research or experimental programs or projects to
be made to building principal where such program is housed.
6. Approximate logs are to be
entered where access is given to permanent records or psychological
or psychiatric reports.
7. Challenge to materials contained in
student records to be made to the principal of the
building where records are maintained. Challenge to materials
contained in psychological reports to be made to the Director of
Pupil Personnel Services located at Monticello High School. If the
building principal or the Director of Pupil Personnel Services
should deny the challenge, an appeal can be made to the
Superintendent of Schools, Administration Building, 237 Forestburgh
Road, Monticello, NY 12701.
8. Schools must have written permission
from the parent or eligible student in order to release personally
identifiable information from a student’s education
record maintained by or on behalf of the school. However, the law
allows schools to disclose those records without consent to certain
parties including the following:
- School officials with
legitimate educational interest such as a district employee
performing a task within the scope of their employment or
contract related to the student;
- Schools to which a student is
transferring;
- To comply with a judicial
order or lawfully issued subpoena;
- Appropriate officials in cases
of health and safety emergencies.
Directory information such as
student’s name, honors/awards, membership on a extracurricular
team, photographs of a student may be disclosed in
superintendent’s newsletter or other media publications for the
purpose of recognizing the student’s accomplishment. If you wish
this information not to be disclosed about your child, please
notify your child’s principal.
9. As required by Federal Law, military
recruiters, upon appropriate request, will be provided access to
secondary school students’ names, addresses, and telephone
listings, unless parents notify the District, in
writing to the building principal at the commencement of the
school year, that they do not wish such information be provided
to military recruiters without their prior consent.
